STATE COURT CASES
In State court, where there is a much larger number of cases tried, Mr. Knizley’s acquittals from juries are extensive. He obtained a not guilty verdict in the capital murder case of State of Alabama v. Jackson, alleging Jackson to be the king pin and primary actor. The State was seeking the death penalty for Jackson. The two co-defendants were convicted of capital murder. Mr. Knizley gained an acquittal in State v. Brooks, accusing Brooks, a lawyer, of conspiring to murder his mother-in-law. Acquittals were had in State v. Monroe, a judge accused of theft and embezzlement in two separate jury trials. An insurance executive in State v. Payne, the St. Paul’s Insurance perjury cases, was acquitted at his jury trial causing the State to dismiss the cases against all other co-defendants. In December 2010 former Mobile County Commissioner Stephen Nodine was tried in Baldwin county for the murder of his mistress. The jury could not reach a verdict and a mistrial declared, After the mistrial the murder case against the Commissioner was dismissed by the Attorney General. In 2011 the Mobile County District Attorney’s child sex abuse prosecutor for 15 years was charged with soliciting a minor for sex. The allegations resulted from an FBI sting operation and the prosecutor was having email and recorded telephone conversations with an undercover FBI agent. That case ended in a hung jury and a motion to dismiss all charges was granted several months after the mistrial. In November of 2012, in the murder case of State v. Beal, the uncontroverted evidence was the accused shot the deceased four times, three times in the back. Beal contended he acted in self-defense. The State’s star witness testified the deceased was shot three times as the accused chased after him. Beal was acquitted of all charges. In the 2015 trial of State v. Deakle the jury acquitted a 60 year old boat captain of felony charges of sodomizing his 13 year old step grand daughter, and a sole misdemeanor charge was dismissed before sentencing. Representation of an heir to the fortune of a well known sporting goods chain alleged to have solicited for sex a minor of another Alabama sporting fame family resolved on a minor non sex related misdemeanor probation disposition.
These are a few examples of the state court acquittals and successful outcomes obtained by Mr. Knizley’s representation.
